Colorado’s drunk driving laws are among the nation’s harshest; it is one of the few states with an adult DWI offense for a blood alcohol concentration as low as .05 percent. If you have been charged with Driving Under the Influence (DUI) or Driving While Ability Impaired (DWAI), you should consult an attorney. Depending on your blood alcohol concentration and history of prior convictions, these offenses can result in significant consequences, including the loss of driving privileges, mandatory monitored sobriety, alcohol education/therapy classes, community service, substantial fines, substantially increased insurance premiums and even jail.
You can no longer expect to plead a drunk driving case down to a non alcohol-related traffic offense in Colorado, unless there is something grossly wrong with the arrest or the evidence against you. Instead, if you want to fight your DUI case, you'll have to do it the old-fashioned way—through the skill and hard work of your defense counsel.

The drug involved can be something legally prescribed by a doctor or obtained over the counter at a pharmacy. A criminal charge can be filed if the drug allegedly had mind- or body-altering effect causing impairment to the ability to drive.
